Requires 3.0 upgrade from apple

Purchased Enigmo when it came out (have 1st gen iPod Touch).
I do not want to purchase the 3.0 upgrade pack from Apple (it provides me with nothing I want).
Enigmo will no longer work on my iPod Touch because it tells me I need to pay Apple for the 3.0 Upgrade to play a game I purchased for about $10.
For shame Pangea Software.
